Gawab.com Responsibilities:

Gawab.com shall design html pages using the information provided by Webmasters. These Webmaster's Customized Pages will allow webmaster to "private label" the email service so that the email address of members signing up for the service will include his/her own domain name.

Gawab.com shall process, through its own server, email communications for members of webmaster's site who join the email service program.

Webmaster Responsibilities:

Using the “Application Setup Wizard” provided by Gawab.com for this purpose, Webmaster shall provide Gawab.com with the information required to customize his/her email service. Webmaster shall take sole responsibility for ensuring that all graphic designs and text comply with trademark, copyright and all other applicable laws. Gawab.com provides an e-mail solution for any website, except if this web site contains:

�          Adult Materials

�          Tobacco or Gambling services

�          Non authorized copyrighted materials

General Policies:

Gawab.com policies apply to all subscription accounts. Every customer who creates an email account through this program is deemed to be a customer of Gawab.com. All of the rules, operating procedures and policies of Gawab.com regarding customer subscriptions will apply to all subscription orders we receive through Webmaster's Customized Pages.Gawab.com reserves the right to reject any subscription order that does not comply with its rules, operating procedures and policies. Webmaster may not make or accept any offer on behalf of Gawab.com. Gawab.com is not responsible for any representations made by the Webmaster that contradict its policies.

Generation of Revenue:

Webmaster operating under the “Basic Service” contract is prohibited from charging or inferring any charge for subscriber's use of service. However, Webmaster may, at his sole discretion, present banner advertisements in an area offered to Webmaster by Gawab.com and charge/collect fees for banner displays at his/her sole discretion.For this purpose, Webmaster will receive 50% of the available Banner advertising placement space to use as desired. Gawab.com, Inc. is not responsible and may not be held accountable for transactions made by Webmaster with any third party with respect to advertising placement.
Gawab.com,Inc. has the right to e-mail the users of the system notifying them about Gawab application updates and advertising contents.

Service Interruption:

Gawab.com will make every effort to keep its email service operational. However, certain technical difficulties may, from time to time, result in temporary service interruptions. The Webmaster agrees that Gawab.com shall not be held liable for any of the consequences of such interruptions and Webmaster acknowledgesthat such interruptions shall not be considered a breach of this agreement.

Term of the Agreement:

The term of this Agreement shall begin on the date the Webmaster application is approved by Gawab.com (except when the Webmaster Domain Name is to be shown as the email host name for which the term shall begin when authorized transfer of Webmaster's MX record to Gawab.com is duly effected), and shall end when canceled by either party.

Agreement Modifications:

Gawab.com reserves the right to change, alter or otherwise modify any of the terms and conditions in this agreement, at any time and in its sole discretion, by posting an updated agreement on its Web site. Webmaster is responsible for reviewing this document from time to time in order to be apprised of any changes that have been made.

Termination of Agreement:

Either Gawab.com or the Webmaster, at their sole discretion, may choose to cancel this agreement at any time by giving a 30days written notice of cancellation to the other party. If Webmaster is found to be in violation of any of the terms or conditions herein, Gawab.com may cancel this agreement without notice.

Warranty Disclaimer:

Gawab.com makes no warranties with regard to this program, either expressed or implied, arising by law or otherwise, including without limitation an implied warranty of merchantability or fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, or usage of trade.

Limitation of Liability:

Gawab.com shall have no liability for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or with respect to this agreement, even if Gawab.com has been advised of the possibility of such damages. In addition, Webmaster shall hold Gawab.com, Inc., its officers, directors, employees, agents, successors and assigns, harmless from and against any third party claims arising from service interruptions resulting from Webmaster conduct.No translation found

Miscellaneous:

Webmaster and Gawab.com are independent contractors and nothing in this Agreement is intended to or will create any form of partnership, joint venture, agency, franchise, sales representative or employment relationship between the parties. Webmaster shall not assign this Agreement, by operation of law or otherwise, without the prior written consent of Gawab.com. Subject to the foregoing restriction, this agreement is binding upon, insures to the benefit of and is enforceable by the parties and their respective successors and assigns.

By submitting your application to the Gawab.com Webmaster program, you are declaring your willingness to be bound by the terms and conditions set forth in this Agreement.

Advertisers:

Any dealings with Advertisers on the Service or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the Advertiser or other third party. Gawab.com shall not be responsible or liable for any part of any such dealings or promotions.

Storage:

The amount of email storage space per member is limited to the selected email package storage which varies between 15 MegaBytes to 2048 MegaBytes. Some email messages may not be processed due to space constraints. You agree that Gawab.com, once exceeding your storage quota, is not responsible for the deletion or failure to store messages or other information. Gawab.com prohibits the use of the allocated space primarily for the storage of certain file types such as video, music, software and games.
 

Spam:

Spam refers to unsolicited commercial or personal email. It pollutes the Internet with many copies of the same message, forcing it on people who have not requested the information it contains. Spam ties up the Internet's valuable resources by forcing the resources to process very large volumes of non-requested mail.

Using Gawab.com mail service for the purposes of spamming is expressly forbidden:

�          Spamming will not be tolerated.

�          account used for spamming will be terminated immediately.

�          We will notify the ISP or access provider of any spamming activity by an individual, and prompt them for action against that person.

�          Using the service in any way for spamming purposes, whether directly or indirectly, will expose an individual to legal action.

�          Forging email headers is illegal and will result in legal action.

Gawab.com will immediately terminate any account that it believes, in its sole discretion, is transmitting or is otherwise connected with any Spam or other unsolicited bulk email.

Pornography:

Sexually explicit pictures, writing, or other material whose primary purpose is to cause sexual arousal.

2) Gawab.com is applying advanced technologies in filtering pornographic emails either they came from mailing lists or pornographic websites.

Member Conduct:

You are solely responsible for the contents of your transmissions through the Service. Your use of the Service is subject to all applicable local, state, national and international laws and regulations. Therefore, you agree:

�          to comply with all applicable laws regarding the transmission of technical data exported through the Service.

�          that you shall not use the Service for illegal purposes.

�          that you shall not interfere or disrupt networks connected to the Service.

�          that you shall comply with all regulations, policies and procedures of networks connected to the Service.

The Service makes use of the Internet to send and receive certain messages; therefore, your conduct is subject to Internet regulations, policies and procedures. The following are considered to be unacceptable practices if carried out by any subscriber:

�          Using the auto-responder, vacation reply, forwarding or POP retrieval features with other Web-based mail providers that have the same options, to prevent the creation of “infinite mail loops”.

�          Providing false data on the registration forms and surveys, including the fraudulent use of credit cards.

�          Using the service in connection with chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).

�          Harvesting or otherwise collecting information about others, including email addresses, without their consent.

�          Creating a false identity or forging an email address or header, or otherwise attempting to mislead others as to the identity of the sender or the origin of the message.

�          Transmitting through the service unlawful, harassing, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.

�          Transmitting any material that may infringe the intellectual property rights or other rights of third parties,including trademark, copyright or right of publicity.

�          Transmitting any material that contains viruses, Trojan horses, worms, time bombs or any other harmful or deleterious programs.

�          Interfering with or disrupting networks connected to the service or violating the regulations, policies or procedures of such networks.

�          Attempting to gain unauthorized access to the service, other accounts, computer systems or networks connected to the service, through password mining or any other means.

�          Interfering with another member's use and enjoyment of the service or another entity's use and enjoyment of similar services.

If a Member's conduct is found to be inconsistent with the intent of this agreement, Gawab.com retains the right, at its sole discretion, to determine whether or not a Member's conduct is consistent with the letter and spirit of the Terms and Conditions of this service. Gawab.com may terminate Service if a Member's conduct is found to be inconsistent with the intent of this agreement.

Proprietary Rights to Content:

Members acknowledge that content, including but not limited to text, photographs, video, graphics, software, music, sound, or other material contained in either sponsor advertisements or emails presented to Member by Gawab.com or its advertisers (collectively referred to as "Content"), is protected under the laws of copyright, trademark, patent, unfair competition or other applicable laws. Therefore, you are only permitted to use this Content as expressly authorized by Gawab.com or the advertisers associated with the Gawab.com service. Members may not copy, reproduce, distribute, or create derivative works from this Content without the express written authorization to do so by Gawab.com or the advertiser.

Gawab.com provides you with a FREE service, therefore it shows advertisements within your account, by signing up for an account with Gawab.com you agree to:
